Privacy Laws in Texas

Historically, anti-sodomy laws have been used as the basis for all types of discrimination against lesbian, gay, bisexual and transgender people. The Texas "Homosexual Conduct" Law, Section 21.06 of the Penal Code, violates the constitutional right to equal protection under the law of LGBT Texans.

Furthermore, this law violates the right to privacy by criminalizing sexual behavior between consenting adults.

On June 26, 2003, the U.S. Supreme Court overturned all sodomy laws in the United States.

Equality Texas will continue to oppose any law that treats LGBT people differently than heterosexuals. Equality Texas also supports legislation that protects individual privacy.

On Lawrence
Texas' anti-sodomy law was ruled unconstitutional by the U.S. Supreme Court, June 26, 2003, in Lawrence v. Texas.

Penal Code, ยง 21.06. Homosexual Conduct. (1973). 21.06 remains on the Texas lawbooks though it is not enforceable.
