Texas Penal Code 21.06 lists “homosexual conduct” as a misdemeanor crime. Penal Code 21.06 was ruled unconstitutional by the United States Supreme Court in 2003. Although unenforceable, 21.06 remains on the books. This antiquated and unenforced law should be removed from the books so that the written law reflects both constitutional reality and actual practice.
